-These terms apply to personal-use commissions only. For commercial or promotional use, please contact the Artist for separate licensing terms.

Process

-Clients are required to submit their brief within 3 days after booking. If the brief is not received within this timeframe, the booking will be forfeited.

-A 50% deposit is required before work begins. Proof of payment is required.

-The Artist will provide progress updates (e.g., sketch, line art, color).

-Clients may request up to [3] major revisions during the process. Minor adjustments are allowed.

-Additional revisions may incur extra charges.

-Commissioning Omakase does not provide progress updates and edits.

• How to Brief

Payment

-All prices are in Thai Baht and United States dollar.

-Payment is made via [Kasikorn Bank, Siam Commercial Bank, PayPal, Buy Me a Coffee].

-A 50% deposit is required up front, with the remaining 50% due upon completion.

-No refunds once the final piece is delivered, unless the Artist cancels the commission.

Deadlines and Turnaround

-The average turnaround time is [3-5 days/weeks], depending on the complexity of the Brief, the number of revisions requested, and queues.

-If there is a specific deadline, it must be discussed before commissioning.

-The Artist is not liable for delays due to lack of communication or unforeseen circumstances.

-In the event of a delay, the Artist will notify the Client as soon as possible with an updated estimated completion time.

Delivery Terms

-A watermarked version of the completed artwork will be provided for review.

-The full-resolution, non-watermarked version will be delivered once the final payment has been received in full.

-All completed artwork will be delivered digitally via email, Google Drive, unless otherwise agreed upon.

-Final file will be delivered in high-resolution 350 dpi, file PNG or JPG.

Usage Rights

-The Artist retains all rights to the artwork, including the right to display it in portfolios, on social media, or for promotional use.

-The Client may use the artwork for personal, non-commercial purposes (e.g., avatars, wallpapers, printing for personal use).

-Do not resell, redistribute, or alter the artwork without the artist's permission.

-NFTs, AI training datasets, and blockchain-related uses are strictly prohibited unless explicitly agreed upon.

Cancellation & Refunds

-The Artist reserves the right to cancel a commission for any reason (e.g., harassment, lack of communication, or personal issues). If the commission is canceled by the Artist before completion, a full or partial refund will be issued.

-If the Client cancels after work has begun, the initial deposit is non-refundable.

Communication

-Please communicate respectfully and clearly.

-The Artist mainly responds within Facebook Messenger.

-If the Client communicates or responds through platforms other than the designated one, it may result in delays in the workflow.

Agreement

By sending payment or confirming the commission, you acknowledge that you have read, understood, and agreed to these Terms of Service.

Process

-ลูกค้าจะต้องจัดส่งรายละเอียดบรีฟภายในระยะเวลา 3 วัน นับจากวันที่ยืนยันการจอง หากไม่มีการจัดส่งภายในระยะเวลาดังกล่าว การจองจะถือว่าสละสิทธิ์ และทางศิลปินขอสงวนสิทธิ์ในการยกเลิกการให้บริการโดยไม่ต้องแจ้งล่วงหน้า

-ต้องชำระมัดจำล่วงหน้า 50% ก่อนเริ่มงาน พร้อมแนบหลักฐานการชำระเงิน

-ศิลปินจะส่งอัปเดตความคืบหน้าของงาน (เช่น ร่างภาพ, เส้น, ลงสี)

-ลูกค้าสามารถขอแก้ไขงานได้ไม่เกิน 3 ครั้งระหว่างกระบวนการทำงาน และสามารถแจ้งปรับแก้เล็กน้อยได้ตามความเหมาะสม

-การแก้ไขเพิ่มเติมเกินจากที่กำหนด อาจมีค่าใช้จ่ายเพิ่มเติม

-การสั่งงานแบบ Omakase จะไม่มีการส่งอัปเดตความคืบหน้าหรือการแก้ไขใด ๆ

-หากเกิดความล่าช้า ศิลปินจะแจ้งให้ลูกค้าทราบโดยเร็วที่สุด พร้อมประเมินระยะเวลาใหม่ในการส่งมอบผลงาน

Delivery Terms

-งานสมบูรณ์จะใส่ลายน้ำเสมอเพื่อส่งพรีวิวให้ลูกค้าตรวจสอบ

-ภาพความละเอียดสูงไม่ใส่ลายน้ำจะส่งมอบให้หลังจากได้รับเงินชำระส่วนที่เหลือครบถ้วนแล้ว

-ผลงานที่เสร็จสมบูรณ์จะจัดส่งในรูปแบบดิจิทัลผ่านทางemail หรือ Google Drive เว้นแต่จะมีการตกลงกันไว้เป็นแพลตฟอร์มอื่น

-ไฟล์ภาพจะถูกส่งในรูปแบบความละเอียดสูง (High-resolution) 350 dpi สกุล PNG หรือ JPG

Usage Rights

-ศิลปินยังคงเป็นเจ้าของสิทธิ์ทั้งหมดในผลงาน รวมถึงสิทธิ์ในการนำไปใช้ในพอร์ตโฟลิโอ แพลตฟอร์มโซเชี่ยล หรือเพื่อการโปรโมตอื่น ๆ

-ลูกค้าสามารถนำผลงานไปใช้ได้เพื่อวัตถุประสงค์ส่วนตัวที่ไม่ใช่เชิงพาณิชย์เท่านั้น (เช่น ใช้เป็นรูปโปรไฟล์ ภาพพื้นหลัง หรือปริ้นท์เก็บไว้ใช้ส่วนตัว)

-ห้ามนำผลงานไปจำหน่ายต่อ เผยแพร่ซ้ำ หรือดัดแปลง โดยไม่ได้รับอนุญาต

-ห้ามนำผลงานไปใช้ใน NFT เจนข้อมูล AI หรือกิจกรรมใด ๆ ที่เกี่ยวข้องกับบล็อกเชน(Blockchain) โดยเด็ดขาด เว้นแต่จะได้รับความยินยอมจากศิลปินอย่างชัดเจนล่วงหน้า

Cancellation & Refunds

-ศิลปินขอสงวนสิทธิ์ในการยกเลิกงานคอมมิชชันด้วยเหตุผลใด ๆ ก็ตาม (เช่น การคุกคาม การไม่ตอบกลับ หรือปัญหาส่วนตัว) หากศิลปินเป็นผู้ยกเลิกงานก่อนเสร็จสิ้น จะคืนเงินบางส่วนหรือทั้งหมดตามความเหมาะสม

-หากลูกค้ายกเลิกงานหลังจากที่เริ่มทำไปแล้ว มัดจำที่ชำระไว้จะไม่สามารถขอคืนได้

Communication

-กรุณาสื่อสารด้วยความสุภาพและชัดเจน

-ศิลปินจะตอบกลับผ่านทาง Facebook Messenger เป็นหลัก

-หากลูกค้าติดต่อหรือตอบกลับผ่านทางแพลตฟอร์มอื่น ๆ อาจส่งผลให้การดำเนินงานล่าช้า

Agreement

การชำระเงินหรือยืนยันการจองคอมมิชชัน ถือว่าลูกค้าได้อ่าน ทำความเข้าใจ และยอมรับข้อกำหนดและเงื่อนไขในการให้บริการฉบับนี้แล้ว
